GENERAL TERMS & CONDITIONS OF SALE AND DELIVERY FOR CONSUMERS

This page contains all the general terms & conditions of sale and delivery of all items offered to consumers on the following websites:www.passionforcycling.bewww.passionforcycling.nlwww.passionforcycling.com and www.fr.passionforcycling.be

 

  1. SCOPE.
    1.1.When ordering items through the ‘Passion for Cycling’ online shop, the seller is Wolvenberg NV, with company registration number 0417.886.490, and registered office in Mouterij 10, bus A, 2550 Kontich (hereinafter referred to as ‘Wolvenberg’).

Wolvenberg is a Belgian company specialising for over 40 years in cycling clothing and accessories. Through the ‘Passion for Cycling’ website, cycling clothing and accessories from leading brands are offered to individuals for their personal use, i.e. consumers aged 18 years and over. Sales to companies and professionals do not fall under the scope of these general terms & conditions of sale and delivery. They fall under the Wolvenberg general terms & conditions of sale, which can be found on www.wolvenberg.com/algemene-voorwaarden/

1.2. Offers from Wolvenberg, all orders from the consumer, sales agreements between the consumer and Wolvenberg are all subject to these terms & conditions of sale and delivery.

1.3. Placing an order entails a payment obligation for the consumer and means that the consumer accepts these terms & conditions of sale and delivery. For this reason, consumers must have carefully read these terms & conditions of sale and delivery prior to placing an order through the ‘Passion for Cycling’ website, and click on ‘accept’ in order to place an order.

1.4. The invalidity or unenforceability of one of the clauses of these terms & conditions of sale and delivery does not compromise the validity and enforceability of the other clauses.

1.5. Insofar as the these terms & conditions of sale and delivery are also written in a language other than Dutch, the Dutch text prevails in case of discrepancies.

 

  1. OFFERS AND ORDERS
    2.1.The presentation of items on the ‘Passion for Cycling’ website is a non-binding invitation from Wolvenberg to buy these items.

2.2. Wolvenberg undertakes to process orders placed through the website as long as stocks last and provided that the consumer has accepted and complies with these general terms & conditions of sale and delivery.

2.3. Wolvenberg is entitled to refuse an order in case it suspects bad faith or wrongdoing, or if Wolvenberg suspects that the consumer is acting as a professional reseller/intermediary.

In such a case, Wolvenberg will immediately refund what you have paid.

 

  1. PRICE AND PAYMENT
    3.1.The prices specified at the time of ordering are the prices that apply. However, Wolvenberg reserves the right to rectify any potential errors (e.g. ensuing from a technical fault). In such a case, Wolvenberg will contact you immediately and ask you to place a new order.

3.2. All sales prices are in euros, including all taxes at the rate that applies by law. Before you place your order, the shipping costs will be shown next to the sales prices.

3.3. Wolvenberg may at any time change its sales prices and shipping costs. Price changes have no effect on ongoing agreements with consumers.

3.4. You may pay for your order in the following ways:

  • Paypal
  • Mistercash/Bancontact
  • Visa
  • iDeal
  • Mastercard
  • Maestro

The order will only be considered to have been placed once the payment for the order has been successfully completed.

 

  1. DELIVERY - DELIVERY METHODS AND TRANSFER OF RISK
    4.1. A delivery is understood to be the time at which you or a third party you have indicated physically receives the items purchased.

4.2. Wolvenberg undertakes to deliver items within a maximum of four weeks. This period only starts counting after successful payment of the full price (sales prices + shipping costs). Wolvenberg shall under no circumstances be held liable for delays or failures in delivery caused by the courier.

4.3. The risk for the items ordered transfers to you as soon as you or a third party indicated by you, who is not the courier, physically takes delivery of the items.

 

  1. COOLING OFF PERIOD
    For items not made to the consumer’s specifications and/or not clearly intended for a specific person, you are entitled to cancel the agreement within 14 days of delivery of the items, without specifying a reason.

For this, please use the cancellation template form or any other unambiguous statement.

In this case, send the items back to Wolvenberg as quickly as possible and in any event within 14 days after notifying your intention to make use of the cooling-off period, in the original packaging in which you received them. You pay the costs for sending the items back.

Where applicable, you may be liable for the loss of value of the sold items ensuing from handling the items beyond what was necessary to establish the items’ nature, characteristics and operation.

 

  1. COMPLAINTS - LIABILITY - GUARANTEE
    6.1.Statutory guarantee: As a consumer, you benefit from a statutory guarantee of conformity of the items purchased for a period of two years to be counted from the delivery (cf. Article 1649quater of the Belgian Civil Code).

If you identify a lack of conformity, you must inform Wolvenberg by two months from the date on which you identified the defect, failing which you may no longer invoke the lack of conformity.

If you have informed Wolvenberg on time of a lack of conformity and the defect falls under the statutory guarantee, the item will be repaired or replaced free-of-charge. If the costs of repair are disproportionate, Wolvenberg may replace the item with a similar one.

Wolvenberg will not be obliged to repair or replace, inter alia in the following cases:

  • damage that occurs deliberately or through negligence
  • normal wear and tear
  • non-compliance with the usage and/or maintenance instructions
  • improper use

6.2. Exclusion for indirect or consequential damage: Wolvenberg’s liability is always limited to the amount of the purchase price of the sold goods, with express exclusion for any indirect, special, incidental, punitive damage, consequential damage or product damage, including but not limited to transport costs, travel and accommodation costs, loss of earnings, and business interruption.

  1. PRIVACY STATEMENT
    Wolvenberg cares about your privacy and therefore always acts in accordance with the provisions of the General Data Protection Regulation (‘GDPR’). The full privacy statement can be found here.

 

  1. APPLICABLE LAW AND COMPETENT COURTS
    All agreements between you and Wolvenberg and disputes relating thereto shall be governed by Belgian law.

Any dispute as to the validity, interpretation, performance or cancellation of these terms and conditions of sale and delivery and the agreements to which these terms and conditions of sale and delivery apply shall come under the sole jurisdiction, at the claimant’s choice, of the Courts of the Seller’s headquarters or the courts of the judicial district where the defendant resides, without prejudice to the right of Consumers to appeal to the provisions of Article 624 of the Belgian Judicial Code or Regulation (EU) on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters.
